TERMS.

This is a plain-English draft for Talon to review. It is not legal advice and has not been checked by a lawyer. Parts in [brackets] need a decision before launch.

1. WHO WE ARE

XEPA is made by Mundo Frameworks LLC, registered in Florida, United States (“XEPA”, “we”, “us”). These terms cover the XEPA iPhone app, the XEPA plugin for Adobe Premiere Pro, and purchases on this website. By using them you agree to these terms.

2. YOUR FOOTAGE

Your videos and shots are yours. XEPA traces them on your own device and we never receive them. You are responsible for having the right to use the footage you trace and share.

3. WEBSITE LICENCES

  • Plugin (one-time license — $60 Founder price for the first 100 buyers, regular price $80): covers the XEPA Adobe Premiere Pro plugin (Mac & Windows) for every 1.x version, and also includes the XEPA Live Tracer when it ships. License works on up to 2 computers.
  • Plugin Monthly ($15/mo): monthly plan (no yearly plans). Covers the Adobe Premiere Pro plugin (Mac & Windows). License works on up to 2 computers. iPhone subscriptions are separate through Apple.
  • Complete ($19.99/mo): in development; will include the XEPA Live Tracer when it ships.
  • Mobile (in-app only): mobile subscriptions are offered in-app only inside the iPhone app via the Apple App Store and are not sold on this website.

Licenses are for the buyer and may not be shared or resold. We grant you a license to use XEPA; we do not sell you the software itself. Do not copy, resell, reverse-engineer, or try to bypass the license checks, except where applicable law allows it.

4. TRIALS & WATERMARKS

XEPA includes a 1-week free trial with full-quality exports and no watermarks.

5. PAYING, RENEWING & CANCELLING

  • Website orders: checkout is through Paddle, our Merchant of Record, which charges you and handles sales tax / VAT. Monthly subscriptions renew every month until you cancel (there are no yearly plans). You can cancel at any time; you keep access until the end of the billing period you paid for.
  • iPhone app: the XEPA iPhone app is distributed through the Apple App Store, where Apple’s standard App Store terms apply.
  • Prices: Pricing may change. Launch prices are not final. If the price of a subscription you already have changes, we will notify you before it applies.

6. REFUNDS

Website purchases can be refunded within 14 days of purchase; see the refund policy. This does not limit any mandatory consumer rights you have under the law where you live.

7. WHAT XEPA DOES AND DOESN’T PROMISE

XEPA draws tracers and scoreboards to make your golf videos better. Lines solved by physics, and any distance, apex height, or speed numbers, are visual estimates for video, not launch-monitor measurements. Features described as “soon”, such as the live tracer, are not part of what you buy today, and we do not promise release dates.

8. FAIR USE

Do not use XEPA to break the law, to infringe anyone’s rights, or to attack or overload our services.

9. UPDATES & ENDING

We update XEPA from time to time, and some updates may change features. If you break these terms we may end your licence. You can stop using XEPA at any time.

10. WARRANTY & LIABILITY

XEPA is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim. [Have a lawyer check this section.]

11. GOVERNING LAW & VENUE

These terms are governed by the laws of [governing state / country], and any disputes will be resolved in [arbitration / small-claims / court venue].
